Damage caused by slight negligence by CAD data is only liable if this breaches an essential contractual obligation, but the amount is limited to the damage that is foreseeable and typical for the contract at the time the contract was concluded. Essential contractual obligations are those whose fulfillment characterizes the contract and on which the customer can rely. The customer releases Gühring from claims by third parties. Liability for culpable harm to life, limb or health remains unaffected; this also applies to mandatory liability under the Product Liability Act.
